When Does the Crackdown on Britain's Civil Liberties Stop? Starting with Palestine Demonstrations

In contemporary Britain, protest is no longer a basic freedom. Instead, it has become a privilege that those in power grant or deny at their discretion. This constitutes the implication of proposed measures that the current government is advancing, which would determine the timing and location protests can occur, with possible imprisonment for those who defy these restrictions.

Erosion of Civil Liberties

Earlier governments had already undermined this essential right: the previous Tory administration had given law enforcement sweeping new authorities, which international human rights organizations had condemned as "significant and undue limitations" on civil liberties. Taken together, these progressive attacks on liberty have effectively eliminated the historically earned right to freedom of protest.

Using Atrocity to Justify Suppression

The most recent restrictive measures are being defended by citing last week's terrible anti-Jewish attack on a British mosque. There should be widespread consensus that the security of Jewish communities in Britain must be protected. However, using this horrific incident as a pretext to stifle opposition is not only unrelated to that responsibility but distorts it.

"When you can't draw the line at mass killing, you likely can't establish limits at democracy," commented a prominent American author, a statement that applies equally for the present administration.

Historical Context of Protest

Reflect on Britain's long tradition of public demonstration and direct action against racism and fascism, from the historic 1936 Cable Street confrontation to postwar Jewish anti-fascist movements and the 1970s mobilizations against the far-right organization. Many of these early protesters were branded as radicals in their time, even while they were fighting for the freedoms of marginalized groups.

Present Situation

In today's complicated landscape, here's what's truly occurring: The Israeli government – a sovereign nation – is committing acts that international bodies have characterized as genocide. Its military actions have prompted the global justice body to release legal indictments against Israel's prime minister and his ex-military leader.

International public opinion has shifted dramatically against Israel's military campaign. In Britain, a large percentage of the public believe Israel has likely committed war crimes. Most people would support a complete ban on arms sales to the state, and back the detention of the Israeli leader.

Suppressing Opposition

Having essentially failed the public debate, pro-Israel advocates are now exploiting a despicable antisemitic crime to attempt to suppress a popular campaign against a moral catastrophe. The British government appears to be included in this attempt. Government officials have not enacted extensive restrictions on Israel and have permitted weapon shipments to continue.

People who are demonstrating against the erasure of Gaza have been characterized as dangerous radicals. Yet there's a significant reason why there hasn't been a more extensive crackdown on these demonstrators until now: very limited protesters have made genuinely hateful statements about Jewish people, giving law enforcement little justification to take action.

Problematic Association

Equating Jewish heritage with the policies of the Israeli state is not only manipulative but also harmful. The official definition of antisemitism, adopted by the British government and many organizations, has been appropriately questioned for potentially restricting legitimate criticism of Israel. However, there should be no disagreement about one of its central illustrations: that "making Jewish people generally accountable for actions of the state of Israel" constitutes antisemitism.

Increasing Limitations

This is why we've reached a situation where law enforcement can propose that protests opposing Israel's policies should be canceled because they might "accidentally or deliberately" support antisemitism. Similarly, government officials have declared that acknowledgment of Palestine as a nation has made organizations "complicit" in alleged abuse experienced by Jewish communities.

Double Standards

On the very day as the religious center assault, the Israeli military killed numerous of Palestinians in Gaza – adding to the horrific toll from 24 months of ongoing violence that have taken many thousands of human lives. British political leaders and news organizations have hardly hidden the limited value they assign to Palestinian life. This represents one of the boldest demonstrations of discrimination in contemporary society.

Crossing Thresholds

Our government has already crossed a dangerous boundary by proscribing a specific activist group, a non-violent, human rights-focused direct action organization. Thousands of British demonstrators have been arrested, primarily for carrying placards against genocide and supporting the banned organization. Many of those detained are pensioners; including a former clergyman and the daughter of a Holocaust survivor.

International Parallels

It's not difficult to see where this path leads. In the United States, political leaders helped demonize demonstrations supporting Palestine: a ex-political leader suggested that some were "linked with" foreign governments, while the sitting leader characterized such demonstrations as anti-Jewish. In taking these actions, they helped legitimize the repressive measures on such demonstrations – and on freedom of expression in general.

Looking Ahead

If a conservative administration comes to power, it would be given sweeping powers to suppress dissent. What might a new administration do with this restrictive framework? Our forebears struggled, suffered and sacrificed their lives to secure our liberties. We may eventually regret how casually we permitted them to be eroded.
